  3. Promethean will use your data to provide you with superior products and services;

Below you will find the Promethean Privacy Policy beginning with Promethean’s General Privacy Terms applicable to all Promethean activities and Products (as defined below).

  1. Promethean’s General Privacy Terms:

This Privacy Policy applies to all products, services, websites and applications offered by Promethean Limited, Promethean, Inc. and all Promethean companies controlled by or under common control with Promethean Limited (collectively, “Promethean” or “Promethean Group”). In addition, the Privacy Policy applies to Promethean’s general operating activities to include but not be limited to all human resources related activities.

We refer to all Promethean products, services, websites and applications collectively as the “Products” or, individually as a “Product” within this Privacy Policy.

The privacy of individuals that we interact with has always been and continues to be of the utmost importance to Promethean. Therefore, we have developed this Privacy Policy to clearly describe how we collect, use, disclose, transfer, and store Personal Information. Please read the following carefully. By using any Promethean Product, you agree to the terms of this Privacy Policy as well as any additional Privacy Policy provisions that apply specifically to the Promethean Product that you are using (for Privacy Policy provisions applicable to specific Promethean Products please see section 9 below).  If you do not agree to the terms of this Privacy Policy or the Privacy Policy provisions that apply specifically to a Promethean Product, please do not use the Promethean Product.  

Please note that in order to use any Promethean Product, you authorize Promethean to transfer your personal information across national borders and to other countries where Promethean and its partners operate, including the United States. The privacy protections and rights of authorities to access your information in these countries may not be equivalent to those in your country. We will only transfer your personal information to these countries when we determine the transfer to be necessary to provide the Product and we will take steps intended to ensure that your personal information continues to receive appropriate and adequate safeguards and protections.

The terms “we,” “us” and “our” as used in the Privacy Policy refer to Promethean.

“Personal Information” as used in this Privacy Policy means any identifier or information that, directly or indirectly, can be used to identify a natural person.

We promise to process your Personal Information in a manner that is always lawful, fair and transparent and we will always provide you with choice and control over the use of your Personal Information in accordance with prevailing laws and obligations.

We may disclose your Personal Information to any Promethean company within the Promethean Group of companies provided, however, use of your Personal Information by any Promethean company will be in compliance with the terms of this Privacy Policy and the terms of Promethean’s IntraGroup Agreement for Data Transfers which contains the European Commission approved standard contractual clauses for the transfer of Personal Data.   1. Collection and Use of Personal Information

We collect and use your Personal Information in multiple ways and you may be asked to provide your Personal Information anytime you are in contact with Promethean. For example, we may collect and use your Personal Information when you:

  1. fill out forms on a Promethean owned and operated Internet site requesting further information about our products and services;
  2. register to use any of our products or services or create an account within any of our products or services;
  3. post to our support community, submit a request for help or support to us or otherwise ask for help from our support team;
  4. provide your information to Promethean, either directly or via other means, at a trade show or other event that Promethean is hosting or participating in;
  5. use our partner portal or any other website that we may make available for individuals or companies selling Promethean products or services;
  6. seek to download Promethean software;
  7. participate in an online survey;
  8. contact us or engage with us in any way to include but not be limited to any online chat feature on any website, Product or service that we offer or make available;
  9. enter a competition or promotion;
  10. register to participate in a webinar or other event that Promethean is sponsoring, operating, delivering or participating in;
  11. apply for a job or position with Promethean;
  12. report a problem with any of our Internet sites; or
  13. interact, in any other way, with Promethean that results in the collection or processing by Promethean of your Personal Information.

We may collect Personal Information to include but not be limited to your name, email address, mailing address, phone number, IP or MAC address or other unique identifiers. If and when we determine necessary, we may also collect additional categories of Personal Information.

In addition, we may collect your Personal Information from other sources such as, for example, publicly available Internet sites or records, or from third-parties that provide us with Personal Information for our lawful use.

When we collect Personal Information, we will endeavor to minimize the Personal Information collected to only the limited amount of Personal Information we need for our purposes.

We will only use your Personal Information when we have one or more of the following lawful basis for processing your Personal Information:

  1. our processing is necessary for the performance of a contract or to take steps prior to entering into a contract;
  2. our processing is necessary for compliance with a legal obligation;
  3. our processing is necessary to protect the vital interest of you or another natural person;
  4. our processing is necessary for the performance of a task carried out in the public interest;
  5. our processing is necessary for the purposes of our legitimate interests or the legitimate interests of a third-party; or
  6. you have given consent to the processing.

The Personal Information we collect allows us to:

  1. deliver our Product(s) to you;
  2. ensure that content from our Product(s) is presented in the most effective manner for you;
  3. provide you with information, Products, or services that you request from us or that we believe may be of interest to you;
  4. carry out our obligations arising from any contracts entered into between you and us or between us and the organization that you are affiliated with;
  5. keep you updated or posted on Promethean’s latest Product announcements, software updates, and upcoming events;
  6. create, develop, operate, deliver, and improve Promethean’s Products, services, content, marketing and advertising;
  7. send important notices such as communications about changes to our terms, conditions, and policies and to administer programs such as sweepstakes, contests, or similar promotions;
  8. undertake and perform other tasks or activities that we have a lawful basis to undertake and perform; or
  9. engage in other lawful business activities.

In all instances that we ask you to provide your Personal information, you are not required to provide the Personal Information that we have requested.  However, if you choose not to do so, in many cases we will not be able to provide you with our Product or respond to queries you may have.

If you receive any email, message or other communication from us and you do not wish to receive further communications from us, you can opt out at any time by (i) unsubscribing at the bottom of the email from Promethean, (ii) sending an email to [email protected] including your name and a brief explanation of the purpose of your email, or (iii) calling Promethean at one of the following phone numbers: in the US (888) 652-2848; outside in the US, +44(0) 1254 298 598.

Please also note that Promethean also collects data in a form that does not, on its own, permit direct association with any specific individual user.  For example, we may collect information about your computer, including, where available, your device type, operating system, and browser type as well as information regarding your activities on one of our websites or applications such as your browsing actions and patterns.  This information allows us to better understand customer behavior, improve our Products, and improve the user experience with our Products. This information is aggregated and used to help us understand which parts of the Product are of the most interest and to improve users’ experiences on or with our Products.

For many of the same reasons as outlined above, we may use a cookie file, which is stored on the hard drive of your computer. These files help us to improve our websites and deliver better and more personalised Products. Cookies enable us to:

  • ensure that content from our websites is presented in the most effective manner for you and for your computer;
  • speed up your use of the website;
  • store information about your preferences;
  • customise the website according to your individual interests;
  • estimate our customer base and usage patterns; and
  • recognise you when you return to the website.

You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting, you may be unable to access certain parts of our websites or Products. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you log on to our Product.   1. Where We Store Your Personal Information

We maintain servers around the world and your Personal Information may be processed on servers located outside of the country where you live. Data protection laws vary among countries, with some providing more protection than others. We always work to comply with laws applicable to your Personal Information and we will apply the protections described in this Privacy Policy to your Personal Information irrespective of where your Personal Information may be processed by Promethean.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of the data that you transmit to any Promethean Product. Any transmission is, therefore, at your own risk. Once we have received your information, we will use procedures and security features to try to prevent unauthorised access.

  1. Disclosure of Your Information
  • Except as provided for herein, we will not sell or share Personal Information with third parties for their marketing purposes or advertisements unless you give us your consent to do so.
  • We may share your Personal Information with certain trusted third-party companies and individuals to perform tasks on our behalf, but strictly for the purpose of carrying out their work for us, for example, to help us provide the website, to enhance the website, to increase the website’s functionality and user friendliness, to provide customer support, to improve your experience on the website, to respond to your inquiries or questions, or to provide you with information regarding our Products. Unless we tell you differently, these trusted third-party companies do not have any right to use your Personal Information beyond what is necessary to assist us with providing you the best possible service. To the extent we share Personal Information with any third party, we require them to comply with the requirements of a data processor under GDPR.
  • We may disclose your Personal Information if Promethean or substantially all of its assets are acquired by a third party, in which case Personal Information held by Promethean will be included among the transferred assets.
  • We may disclose your Personal Information if Promethean is required by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence. We may also disclose information about you if we determine that, for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate; and
  • We may disclose your Personal Information if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or users.
  1. Children

We understand the importance of taking extra precautions to protect the privacy and safety of children. In addition, in the countries that we offer services where we collect the personal information of children we comply with the applicable laws regarding the collection of the personal information of children. Specifically, we do not knowingly collect, use, or process Personal Information from children under the age applicable to their country of residence without verifiable parental consent or, alternatively, a teacher, school or school district has consented to or authorized the processing of the student Personal Information for an educational purpose.

If we ever learn that we have collected the Personal Information of a child without parental consent when parental consent is required or without other lawful authorization, we will take steps to delete the information as soon as possible.  If you know that we have inadvertently collected any Personal Information about a child without the required parental consent or authorization, please contact us at [email protected].

  1. Do Not Track (DNT)

Promethean does not track its users over time or across third party websites to provide targeted advertising, and therefore, does not respond to Do Not Track (DNT) signals.

  1. Links to Other Sites

Our Products may, from time to time, contain links to and from the websites and services of third parties to include but not be limited to our partner networks, advertisers, affiliates or other third parties. Please note that Promethean does not operate, manage or control the websites, services, or Personal Information processing of any such third parties and Promethean does not accept any responsibility for the processing of Personal Information by any such third party. Please carefully review the Privacy Notice, Terms of Use and Cookie Policy of each third party, as applicable, prior to clicking on any link to such third party’s website or service or allowing such third party to process your Personal Information.

  1. Changes to Our Privacy Policy

Any changes we may make to our Privacy Policy in the future will be posted on this page. Please check this page from time to time to take notice of any changes we make, as they are legally binding on you.

  1. Additional Privacy Terms Applicable to Specific Promethean Products.

This section describes how Promethean collects, uses and discloses your Personal Information in connection with its Products.  

Your use of a Product, and any information you provide through a Product, is always subject to this Privacy Policy and the Promethean Product Terms of Use.  The term “Personal Information”, as used in this Privacy Policy, shall only apply to the personal information of individual Users and refers to any information or identifier that can be used to identify a natural person, including, for example, name, email address, phone number, mailing address, and IP address. Personal Information does not include information that has been aggregated or made anonymous such that it can no longer be reasonably associated with a specific person or directly identify them.  The term “Student”, as used in this Privacy Policy, refers to any person, regardless of age, attending a public or non-public educational institution.  are references to the Personal Information of student users or students that have their Student Personal Information entered into the Promethean Product by an authorized teacher, school or school district or, if applicable, the student. General references to “information” shall apply to all users. This Privacy Policy in no way restricts or limits our collection and use of aggregated information that does not identify any person, and provided such information does not identify any person, we may share aggregated data about our users with third parties for various purposes.

  1. How Do We Collect Your Information and What Do We Use It For? 
    1. Information You Provide to Us.
      1. Explain Everything Product
        1. Account Information for Adults.  We intentionally minimize the Personal Information required to use Promethean Products. A username and password are required to create and access your account.  In addition, we may also collect contact information such as first name, last name, User type (e.g., teacher, administrator, etc.) and e-mail address. We process this information to provide the Products to include but not be limited to the EE Service or access to the EE App.  The legal basis for this Processing activity is the performance of a contract and Promethean’s legitimate interest in providing quality, engaging and useful products and services.

          Account Information for Students.  In cases where Promethean provides the EE Service to schools and teachers to improve classroom instruction and student learning outcomes, we may collect or have access to Personal Information about students (“Student Data”). Only students who have been provided a class code by a school or teacher, or that have been assigned a license by a school or teacher, may register as a “Student” for an EE account and use the EE Service.  In circumstances where a school or teacher has provided a Student with a class code, or where a Student has been assigned a license by a school or teacher, we will collect limited Personal Information from the Student. The type of information we collect will depend on how the school or teacher use the EE Service, but could include the student’s first and last name, email address, username and password, assessment data, assignment data, and other classroom content. We consider Student Data to be highly confidential and use this data solely to provide our EE Services to the school or on the school’s behalf, and in limited ways, for internal purposes in accordance with our Promethean Product Terms of Use.  Our collection, use, and disclosure of Student Data may be governed by our agreement with the student’s School. For schools located in the United States, in the event product licenses are assigned to students, you acknowledge and agree that under the Family Educational Rights and Privacy Act (FERPA) Promethean is acting in the capacity of a school official and all Student Data will remain under the school’s direction and control. For schools located in the UK and EU, the school will be the controller with regards to any Student Data uploaded into the Promethean product and Promethean will be the processor with regards to any such Student Data.  Applicable law or any agreement with a school will take priority and shall be controlling if and to the extent there is any conflict between any applicable law, or the provisions of any agreement with a school, and this Privacy Policy.  If you have any questions about our collection and use of Student Data, please contact us at [email protected] If you have any questions about reviewing, modifying, or deleting Personal Information of a student, please contact your educational institution directly.
        2. User Submission.  We receive and store any information you knowingly enter on the into Promethean Products (including through User Submissions (as defined in the Agreement), whether via computer, mobile phone, tablet, or other wireless device that you provide to us in any other way. This information may include Personal Information such as your name and email address and Student’s Personal Information.
        3. Student Information.  Promethean collects limited Personal Information from students (“Student Personal Information“) only when that student’s school, district, and/or teacher has contracted with Promethean for the use of Promethean Products and such use leads to Promethean’s collection of Student Personal Information for an educational purpose and the use and benefit of the learning environment.

          Students under 18 years of age (“Underage Student”) are not allowed to create an account within a Promethean Product or Online Service unless the Student’s parent or guardian has provided verifiable parental consent or, alternatively, a teacher, school or school district has consented to the processing of the Student Personal Information for an educational purpose. Underage users may only utilize a Product under a student account established by a school customer as part of a group account or an account of a customer over 18 years of age.  In all such cases, a student is only permitted to use the Product in an educational context.  Promethean does not offer, and Underage users are not permitted, to use any Promethean Product for any purpose, including any commercial purpose, other than an educational purpose.  If Promethean becomes aware that an Underage user is using a Product for any purpose other than an educational purpose, or where the adult or School customer does not have the right, authority or legal basis to authorize the Underage user to use the Promethean Product, Promethean may, in its sole discretion, immediately terminate the Underage user’s account and delete all data associated with the account.

          SCHOOLS ARE REQUIRED TO COMPLY WITH APPLICABLE LAW AND ARE ONLY PERMITTED TO UPLOAD CONTENT TO THE PRODUCTS THAT CONTAIN THE PERSONAL INFORMATION OF ANY STUDENTS IN COMPLIANCE WITH APPLICABLE LAW.  FOR SCHOOLS LOCATED IN THE UNITED STATES, IN THE EVENT PRODUCT LICENSES ARE ASSIGNED TO STUDENTS, YOU ACKNOWLEDGE AND AGREE THAT UNDER THE FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT (FERPA) PROMETHEAN IS ACTING IN THE CAPACITY OF A SCHOOL OFFICIAL AND ALL STUDENT PERSONAL INFORMATION WILL REMAIN UNDER THE SCHOOL’S DIRECTION AND CONTROL. FOR SCHOOLS LOCATED IN THE UK AND EU, THE SCHOOL WILL BE THE CONTROLLER WITH REGARDS TO ANY STUDENT PERSONAL INFORMATION UPLOADED INTO THE PROMETHEAN PRODUCT AND PROMETHEAN WILL BE THE PROCESSOR WITH REGARDS TO ANY SUCH STUDENT DATA.
  2. One.prometheanworld.com Product
  1. Account Information.  We intentionally minimize the Personal Information required to create a One.prometheanworld.comworld.com account.  Specifically, limited information such as an e-mail address and password are required to create and access your account. We process this information to provide the One.prometheanworld.comworld.com Service to you. The legal basis for this Processing activity is the performance of a contract and Promethean’s legitimate interest in providing quality, engaging and useful products and services.
  2. Contact Information.  In addition, we may collect contact information such as first name, last name, and e-mail address. We process this information to provide the Service, Mobile Application or the System to you. The legal basis for this Processing activity is the performance of a contract and Promethean’s legitimate interest in providing quality, engaging and useful products and services.
  3. Your organization name (e.g., school name, district name, etc.). We may collect this information to associate your account with other accounts within your organization and to ensure that the administrator of your organization’s use of the Product or Online Service can perform administrative functions relative to your account (and all other accounts associated with your organization).
  4. Each time you login and access the Product or Online Service, we will collect certain login information which may include your IP address, device type, name, date and time of your visit, information on your browser version, information on your operating system, including language settings, MAC addresses, and User ID. We will Process this information to provide you with access to One.prometheanworld.com Service. The legal basis for this processing activity is the performance of a contract and Promethean’s legitimate interest in providing quality, engaging and useful products and services and to guarantee the stability and security of the One.prometheanworld.com Service.

You are under no obligation to provide Personal Information to a Product when such information is requested. However, if you choose to withhold any requested information, we may not be able to provide you with the Product or certain other services or features within the Product. 

You may access, correct, update, or delete your Personal Information in your profile by making the change on your account profile page. If you encounter any problems correcting, updating or deleting any Personal Information in your profile, please contact us at [email protected].

Please be advised that requesting removal of, or not providing, certain information may result in your not receiving notification of updates to the Product or Online Service or other valuable information regarding your use of the Product or Online Service.  Failure to provide information requested by Promethean or removing certain information may mean that you are not able to access relevant features of the Product or Online Service and may even result in your not being able to use the Product or Online Service at all.

If you are using the Product or Online Service as part of an organization such as a school or school district, you may need to direct any request to access, make changes to or delete Personal Information including Student Personal Information to your School’s designated Administrator.  Your school’s Administrator may have access to the School’s Authorized Users’ information and the ability to update, correct, or delete the information contained therein.

Please also be advised that we have entered in agreements with certain Schools that require us to direct any requests for any change, update or deletion of Personal Information contained within an account affiliated with the School to the School for action.  Accordingly, in some instances, we may be required to direct you to contact your School to ask your school to instruct us to change, update or delete the Personal Information within your account.

For Product licenses purchased directly from a Promethean website, Personal Information and payment information will be collected by a third-party payment processor via its electronic payment platform. Promethean does not collect or store any payment information.  Please note that the collection and processing of any Personal Information and payment information by a third-party payment processor will be governed by the Terms of Conditions and Privacy Policy of the third-party payment processor.  Please review the third-party payment processor’s Terms and Conditions and Privacy Policy prior to entering any Personal Information or payment information requested for payment purposes. Please note that the third-party payment processor may retain your Personal Information and payment information for processing payment transactions.

  1. Your use of the System. During your use of a Product, we may collect and process Personal Information that is sent to us automatically by your Web browser or mobile device in connection with your use of the Product (as applicable):
    1. The Product may make use of your device attributes (e.g., IP address, the name and version of your operating system, the name and version of your browser, the date and time of your use of the Product, etc.) and settings that will allow us to generally determine your geographic location.  Such technologies may include IP address mapping, or other suitable technologies. We use this information to enhance and personalize your experience and to provide the Product and we will not use such information for any other purpose. The legal basis for this processing activity is the performance of a contract and Promethean’s legitimate interest in providing quality, engaging and useful products and services.
    2. When you contact or send communications to Promethean, for example when you contact customer support, report a problem, or submit questions, concerns, or comments regarding the Product, we may collect Personal Information such as your first name, last name, email address, telephone number and other important information about your inquiry or concern. This information is used to respond to your communications, fulfill your requests, or provide other customer support. This processing activity is based on your consent, in the performance of a contract, depending on the initial purpose for contacting our customer support, and Promethean’s legitimate interest in providing quality, engaging and useful products and services.
    3. When you subscribe to other Promethean Products, features, or activities that we may offer from time to time as a new Product or through the Product, and you submit or upload Personal Information in connection with such features or activities, Promethean will Process such Personal Information for the purposes of providing and delivering such features or activities.  The legal basis for this processing activity is based on the performance of a contract, and Promethean’s legitimate interest in providing quality, engaging and useful products and services.
  2. Cookies and Similar Technologies

    Like most websites, we use cookies and other standard Internet technologies to help us improve our Products.
    1. Cookies. A cookie is a small text file that is placed on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, for example so you don’t have to re-enter such information whenever you come back to the website or browse from one page to another.  A cookie can be classified by its lifespan and the domain to which it belongs. By lifespan, a cookie is either a:
      1. Session cookie which is erased when the user closes the browser; or
      2. Persistent cookie which remains on the user’s computer/device for a pre-defined period.

        As for the domain to which it belongs, there are either:
      3. First-party cookies which are set by the web server of the visited page and share the same domain; or
      4. Third-party cookies stored by a different domain to the visited page’s domain. This can happen when the webpage references a file, such as JavaScript, located outside its domain.

  1. How Do We Use Your Information? In addition to the specific uses above, any Personal Information that you provide or that we collect by or through a Product may be generally used for the following purposes:

We may also use the information you provide in the aggregate to help us generate statistics regarding use of the Service. If you would not like your information to be used in this way, please do not participate in Promethean surveys or, if participating, please provide us only with information you consent to our use of in accordance with this Privacy Policy
    6. To provide technical support or customer service.
    7. To protect the integrity, safety, or security of our Product, Online Service or our Users, and to comply with legal obligations, or enforce compliance with our Promethean Product Terms of Use or other restrictions placed on your use of a Product or Online Service.
  2. Information Sharing
    Promethean may share your Personal Information as set forth below. Please note that Promethean does not sell or rent your Personal Information to third-party companies for their marketing purposes.
    1. Agents and contractors. Promethean may share User Personal Information with Promethean’s third-party agents, contractors, or service providers who are hired to perform services on Promethean’s behalf. These providers may operate or support certain functions of a Product or Online Service. These agents, contractors and service providers are allowed to use the Personal Information shared with them only for the specific tasks or purposes authorized by Promethean as Promethean has determined to be appropriate for delivery of the Product or Online Service.  Any third party’s use of any Personal Information shared with such third party by Promethean will be limited to supporting Promethean in the delivery of Promethean’s Products and Online Services and for no other purposes.  Any Personal Information processed by any third-party supporting Promethean shall be processed consistent with this Privacy Policy. Promethean takes steps to ensure that all service providers engaged by Promethean to process Personal Information can secure and protect any Personal Information we share with them, and, in addition, when appropriate, Promethean requires third parties, agents or contractors to execute a data processing agreement that governs the processing of any Personal Information Promethean may engage such third party, agent or contractor to process.
    2. API Integration.  Promethean Products and Online Services use API integration for several third-party services including, but not limited to, Dropbox, Box, Microsoft, Google Drive, and others. All user login information is collected and stored only by these third-party cloud services. The Products and Online Services do not store or access any login credentials for any third-party services. Please refer to those companies’ privacy policies and terms of service if you have concerns or questions. 
    3. Legal disclosures. We may disclose Personal Information about you as required or permitted by law and/or to comply with a judicial proceeding, court order, or legal process served on Promethean. To the extent permitted by applicable law, we may also disclose Personal Information about you in response to a request from law enforcement agencies, regulators, or other public agencies (including schools or children services) or if such disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using any Promethean Product or Online Service, protect the security or integrity of our Products and Online Services, or enable us to take precautions against liability or to protect our rights.
    4. Business transfers. Information about our Users, including Personal Information, may be disclosed, and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets. When required by applicable law, we will inform you of such disclosure prior to any such disclosure. 
    5. Anonymized information. We share aggregated, automatically collected, or otherwise non-Personal Information with third parties for various purposes, including (i) compliance with reporting obligations; (ii) for business or marketing purposes; (iii) to assist us and other parties in understanding our Users’ interests, habits and usage patterns for certain programs, content, services, promotions and/or functionality available through the Product.  We do not share Personal Information about you in this case.
    6. Product Specific Information Sharing.
      1. Explain Everything Information Sharing with other Users of the Product

        You may choose to populate your user profile on the EE Service with Personal Information, including, without limitation, your name, photograph, and school affiliation. If you are a student, your user profile may only include your username which may be system generated and may have no correlation to your real name). This user profile information will be displayed to other users to facilitate user interaction within the EE Service or facilitate interaction with Promethean. However, please keep in mind that information (whether Personal Information or Student Personal Information or not) or content that you voluntarily disclose or otherwise publish (including User Submissions) through the EE Service becomes publicly available and can be collected and used by others, in accordance with the privacy settings you select in your account preferences.  Your display name may be displayed to other users when you upload content, presentations, images, or videos or send messages through the EE Service and other users can contact you through messages and comments. Please note that certain images, presentations, captions or other content (for example, videos) that you submit to, or create on the EE Service (including User Submissions) may be redistributed through the Internet and other media channels (for example, YouTube) and, consequently, may be viewed on these other media channels by the general public.

        We use YouTube’s API services in connection with the EE Service to provide certain features. As such, you acknowledge and agree that by using the YouTube integration with the EE Service, you are also bound by Google’s Privacy Policy and YouTube Terms of Use. In addition to the rights set forth herein, you may manage your YouTube API data by visiting Google’s security settings page at https://security.google.com/settings/security/permissions.

        Explain Everything web app’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

        Full list of third parties that we disclose personal data to and who act as our subprocessors  for the EE Service can be found in List of Data Subprocessors section, which is a part of that Privacy Policy.
  3. Security and Data Retention
    1. Security. The security of your Personal Information is important to us. When you enter information in a Product or Online Service, Promethean will encrypt that information using secure socket layer technology (SSL) or similar technologies. We have security measures in place to attempt to protect the Personal Information and other information submitted to us and under our control against loss, misuse, and alteration.  While we cannot ensure or guarantee that loss, misuse, or alteration of information will never occur, we use reasonable efforts to prevent it. Please note that no method of transmission over the Internet, or method of electronic storage, is 100% secure.
    2. Retention. Promethean may retain Users’ account data internally for the following purposes:
      1. Billing information, excluding payments made via a third-party payment processor, and transaction histories are retained to resolve subsequent billing disputes and inquiries.
      2. User account history is retained to support subsequent customer service inquiries and to provide, improve and develop Products, and other Promethean products and services.
      3. To promote safety and security on and for the Products or Online Service.
      4. To comply with legal obligations.
      5. For other lawful purposes.

        We may retain your information for as long as is necessary and relevant to your use of a Product or Online Service and our operations, which may include retaining your information beyond the end of your use of the Product or Online Service. We will comply with any lawful request you submit to Promethean regarding the processing of your Personal Information in accordance with applicable law.
    3. External links. Our Products and Online Service may, from time to time, contain links to external sites or applications. We are not responsible for the Personal Information Processing, privacy policies or the content of such third-party sites or applications. When you link to a third-party site or application, you are leaving Promethean’s Product or Online Service and Promethean is not responsible for the Personal Information processing or the privacy practices of any such third-party site or application. In addition, Promethean is not responsible for any content on third-party sites and/or applications.  You should read the terms of use and privacy policy of the third-party site or application before sharing any information such third-party site or application.
    4. Accessing and Updating Your Personal Information

      If Personal Information about you changes, or if you no longer desire to use our Product or Online Service, you may correct, update, amend or delete your account under your account settings at any time.
  4. Retention and Deletion of Personal Information:
    1. We will retain your information for as long as your account is active or as needed to provide you the EE Service, or as described herein. We only want to retain and process your personal information for as long as needed for the purposes that we have collected your personal information.  Accordingly, to protect against retaining or processing your personal information for longer than is needed for the purposes of providing you with the EE Service, we may delete your personal information due to inactivity if you fail to log in or access your account for a period of time.  You may, of course, cancel your account at any time.  If you wish to cancel your account, please contact us at [email protected].
    2. Student Data. Promethean will promptly delete or de-identify Student Data upon request or instruction by the school or teacher within thirty (30) days of such request or instruction. Please contact us at  [email protected] to request account deletion.  We will retain, delete, or de-identify Student Data according to our policies below:
      1. Explain Everything Subscriptions.  Upon expiration or termination of an Explain Everything subscription, all accounts under the subscription will be converted to a free account and data associated with the accounts will remain in the free account, except for student accounts, which are discussed below in more detail.
      2. Free Explain Everything Accounts.  With regards to free accounts, where the EE Service does not detect customer activity for a specified period of time, the EE Service may disable the account and all data associated with the account will be deleted.
      3. Explain Everything Student Accounts.  Student accounts will be disabled in one or more of the following situations:
        1. When a teacher or school’s subscription terminates; or
        2. When a teacher disables a code that was shared with one or more students that allowed the one or more students to create an account.

          In all cases, all Student Data in each disabled account will either be de-identified so that the Student Data in each such disabled account is permanently irretrievable or deleted.  Information associated with a student’s former account that has been de-identified cannot be retrieved or made available to the student via any new student account.  We may maintain anonymized or aggregate Student Data, including usage data, in a form that does not identify a particular individual, for analytics purposes.  Promethean in its sole discretion may delete anonymized or aggregate Student Data at any time.
  5. Children’s Privacy

    Promethean does not knowingly collect any information from children under the age of eighteen (18) unless and until a school or teacher has provided appropriate consent and authorization for a student under eighteen (18) to use the EE Service and for Promethean to collect information from such student.  Please contact us at [email protected] if you believe we have inadvertently collected personal information from a child under eighteen (18) without proper consents so that we may delete such information as soon as possible.
  6. Storage and International Transfer of Your Personal Information

    All Personal Information (i.e., profile data and general End-User content), which we collect, is sent to and stored on secure servers in the United States or as otherwise indicated at the following link: portal.mypromethean.com/opensourcesoftwareandcookies.

    Such storage is necessary to Process the information. Promethean operates globally and we may transfer the Personal Information that we collect from you to our other offices and/or to the third-parties as described herein.  Accordingly, Personal Information may be Processed outside of your country or regional area.  Wherever we transfer your Personal Information, we will take reasonable steps to comply with applicable law, protect your Personal Information, ensure an adequate level of protection, and have appropriate safeguards for our Users’ rights and legal remedies.

    Where does my Data Go?

    You acknowledge, agree and consent to the following: Promethean will store and process Personal Information in various data centers around the world, including the United States, and that your Personal Information may not be stored or processed only within the country in which it was collected unless and except to the extent required by law. If you are located in the European Union (the “EU”) or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.  As such, Promethean has entered into standard EU model contract clauses with its intragroup companies with which it shares Personal Information to ensure that the transfer of personal data of EU citizens outside the European Economic Area is safeguarded in the same way the data is required to be safeguarded in the EU.  You warrant and agree that Promethean may transfer and process your Personal Information in the United States or any other country in which Promethean or its parent, subsidiaries, affiliates, or service providers maintain facilities.  If applicable, you further warrant and agree that you have obtained all necessary consents from your students or Authorized Users for Promethean to process such Personal Information in the United States and elsewhere in the world.

    You are responsible for understanding and complying with the local data protection and data privacy laws where you reside. By using the Product or Online Service, you consent to your Personal Information being sent to and stored at the locations, and countries, as outlined herein.
  9. Security incidents

    Promethean will notify you at the email address you provided to us in the event of a data breach or exposure of your personal data to unauthorized individuals.
  10. For California Users.

    As related to California AB 1584 (Buchanan) Privacy of Student Records: 3rd-Party Digital Storage & Education Software (Education Code section 49073.1), we agree to the following:
    1. Student records obtained by Promethean from a Local Educational Agency (an “LEA”) continue to be the property of and under the control of the LEA.  The LEA retains full ownership rights to the information in the Personal Information and education records it provides to a Product or Online Service.
    2. Promethean Product or Online Services users may retain possession and control of their own generated content by signing into and accessing their Product or Online Service account and downloading (or updating) their information within the Product or Online Service.  Students have access to and control of their own information and student-generated content subject to the limitations imposed by the student’s teacher.  For example, if a student completes an assessment using Promethean’s Product or Online Service and submits the assessment to the teacher within the Product or Online Service, the student may only retain possession and control of (or change answers to) the assessment if permitted by the teacher.
    3. Parents, legal guardians, or eligible students may review Personally Identifiable information in the student’s records and correct erroneous information by contacting their educational institution.  Additionally, Product and Online Services users may access, correct, update, or delete personal information in their profile by signing into the Product or Online Service, accessing their account, and making the appropriate changes, or by contacting us directly from within the Product and Online Service, or submitting your request to us at [email protected].
    4. We are committed to maintaining the security and confidentiality of student records.  Towards this end, we take the following actions: (i) we limit employee access to student data to only those employees with a need to such access to fulfill their job responsibilities; (ii) we conduct background checks on our employees and, specifically, upon all employees that may have access to student data; (iii) we require employees to sign confidentiality agreements prior to being granted access to any sensitive data; (iv) we conduct regular employee privacy and data security training and education; and (v) we protect personal information with technical, contractual, administrative, and physical security safeguards in order to protect against unauthorized access, release or use.
    5. In the event of an unauthorized disclosure of a student’s records, we will (1) promptly notify the LEA unless specifically directed not to provide such notification by law enforcement officials; and (2) enact the response plan and procedures described in the Promethean Data Breach Incident Response Plan that is available to the LEA upon request.
    6. We will not use any information in a student record for any purpose other than those required or specifically permitted by the Terms of Service and Privacy Policy.
    7. We will not use any Personal Information within a student’s records in Products or Online Services to engage in targeted advertising.
    8. We will delete or de-identify student personal information when it is no longer needed, upon expiration or termination of our agreement with an LEA with any deletion or de-identification to be completed according to the terms of our agreement with the LEA, or at the direction or request of an LEA (school).
    9. We will work with the educational institution to ensure compliance with FERPA by providing parents, legal guardians and students with the ability to inspect and review their student records within the Product or Online Service and the means to correct any inaccuracies therein.
    10. We will not make material changes to our Privacy Policy, including adding material practices around material new or additional data collected, or material changes that lessen the previously described protections without prior notice to the LEA.
  11. Privacy Statement Changes and Updates

    We may update this Privacy Policy For Products to reflect changes to our Personal Information practices at any time, so please review this Promethean Products Privacy Policy. If we update this Privacy Policy, changes will be reflected on this page and we will update the “Last Updated” date posted below, and in the event we make material changes, we will make reasonable efforts to notify you. If you do not wish to accept the change(s) you may opt-out by deleting your account.

In the event of any conflict between the terms of this section 9 of the Privacy Policy and any other section of the Privacy Policy, then the terms of this section 9 of the Privacy Policy shall govern and control.
